Attorney General Wattel advises the Supreme Court

Attorney General Wattel has recently advised the Supreme Court to declare the levy of income tax in Box 3 for the years 2016 and 2017 incompatible with the prohibition of discrimination at a systemic level. The Income Tax Act 2001 has been in need of a thorough overhaul for years, but the legislator has so far failed to do so despite various recommendations by experts and research committees. If the Supreme Court follows the advice of the Attorney General, this will be another sign that the legislator urgently needs to address the necessary changes.
